ACDBE Obligation. The City shall never exclude any person from participation in, deny any person the benefits of, or otherwise discriminate against anyone in connection with the award and performance of any contract covered by 49 CFR Parts 23 and 26 on the basis of race, color, sex, or national origin. 11.2.2.1. In administering its ACDBE program, the City shall not, directly or through contractual or other arrangements, use criteria or methods of administration that have the effect of defeating or substantially impairing accomplishment of the objectives of the ACDBE program with respect to individuals of a particular race, color, sex, or national origin.

ACDBE Obligation. This agreement is subject to the requirements of the U.S. Department of Transportation’s Regulations, 49 CFR Part 23. The Concessionaire agrees that it will not discriminate against any business owner because of the owner’s race, color, national origin, or sex in connection with the award or performance of any concession agreement, management contract, or subcontract, or other agreement covered by 49 CFR Part 23.
ACDBE Obligation. The Concessionaire agrees to ensure that ACDBEs as defined in 49 CFR Part 23, and any amendments thereto, have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds provided under this Agreement. In this regard all recipients or contractors shall take all necessary and reasonable steps in accordance with 49 CFR Part 23, and any amendments thereto, to ensure that disadvantaged business enterprises have the maximum opportunity to compete for and perform contracts. Recipients and their contractors shall not discriminate on the basis of race, color, national origin, or sex in the award and performance of DOT-assisted contracts.

Concessionaire agrees to include the above statements in any subsequent concession agreement or contract covered by 49 CFR Part 23 and 26 that it enters into and to cause those businesses to similarly include the statements in further agreements. Concessionaire further agrees that it shall comply with all Airport Concession Disadvantaged Business Enterprise (“ACDBE”) regulations of the DOT as they may be adopted or amended from time to time during the Term.

The Concessionaire agrees that it shall make good faith efforts, as defined in Appendix A, 49 CFR Part 26 (Attachment 1), to meet the concession specific goals for ACDBE participation in the performance of this Agreement. Concessionaire acknowledges that any action or failure to act by it, which violates the ACDBE requirements of this Agreement, constitutes a material breach of this Agreement, which shall entitle the City to exercise all of its rights at law or equity for such material breach.
