Furthermore, to the extent a Licensed Compound or Licensed Product containing ACE-536 fails and a replacement Licensed Compound or Licensed Product containing ACE-536 is selected, any milestones previously paid for such failed Licensed Compound or Licensed Product shall not be paid again with respect to such replacement Licensed Compound or Licensed Product.
