Common use of ACH Transfers to your Account Clause in Contracts

ACH Transfers to your Account. In addition to the other terms in this agreement, any credit to your account for an electronic transfer of funds transmitted through the ACH by an originating depository financial institution (“ODFI”) is provisional until we receive final settlement through a Federal Reserve Bank, or otherwise receive payment in a manner acceptable to us. If we do not receive final settlement or payment, we are entitled to a refund from you for any amount credited to your account and may deduct such amount from your account without notice to you and the ODFI will not be considered to have paid the amount of the credit entry to you. According to the rules set forth by NACHA (as defined below), we are not required to provide you with notice that we have received an ACH transfer to your account unless we have expressly agreed otherwise.
