Common use of ACTIONS AGAINST PERMA Clause in Contracts

ACTIONS AGAINST PERMA. There will be no right of action against PERMA under this coverage unless: 1. The Member has complied with all the terms of this agreement; and 2. The amount the Member owes has been determined with XXXXX's consent or by actual trial and final judgment. This coverage does not give anyone the right to add PERMA as a defendant in an action against the Member to determine the Member's liability.
