Common use of Actions by Escrow Agent Clause in Contracts

Actions by Escrow Agent. Provided that Escrow Agent shall not have received written notice from Buyer or Seller of the failure of any condition to the Closing or of the termination of the Escrow and this Agreement, when Buyer and Seller have deposited into Escrow the documents and funds required by this Agreement (including the balance of the Purchase Price pursuant to Section 2 hereof and each parties share of prorations and Closing Costs) and Title Company is unconditionally and irrevocably committed to issue the Owner's Title Policy concurrently with the Closing, Escrow Agent shall, in the order and manner herein below indicated take the following actions:

Actions by Escrow Agent. Provided that Escrow Agent shall not have received written notice Notice from Buyer or Seller of the failure of any condition to the Closing or of the termination of the Escrow and this Agreement, when Buyer and Seller have deposited into Escrow the documents and funds required by this Agreement (including the balance of the Purchase Price pursuant to Section 2 hereof and each parties share of prorations and Closing Costs) Agreement, and Title Company is unconditionally and irrevocably committed to issue the Owner's Title Policy concurrently with the Closing, Escrow Agent shallshall take the following actions, in the order and manner herein below indicated take the following actionsindicated:

Actions by Escrow Agent. Provided that Escrow Agent shall not have received written notice from Buyer or Seller of the failure of any condition to the Closing or of the termination of the Escrow and this Agreement, when Buyer and Seller have deposited into Escrow the documents and funds required by this Agreement (including the balance of the Purchase Price pursuant to Section 2 hereof and each parties share of prorations and Closing Costs) and Title Company is irrevocably and unconditionally and irrevocably committed to issue the Owner's ’s Title Policy concurrently with all of the Closingendorsements set forth on Exhibit A-1 effective as of the Closing Date, Escrow Agent shall, in the order and manner herein below indicated indicated, take the following actions:

Provided that Escrow Agent shall not have received written notice from Buyer or Seller Sellers of the failure of any condition to the Closing or of the termination of the Escrow and this Agreement, when Buyer and Seller Sellers have deposited into Escrow the documents and funds required by this Agreement (including the balance of the Purchase Price pursuant to Section 2 hereof and each parties share of prorations and Closing Costs) and Title Company is irrevocably and unconditionally and irrevocably committed to issue the Owner's Title Policy concurrently in accordance with the Closingterms hereof, Escrow Agent shall, in the order and manner herein below indicated indicated, take the following actions:

Actions by Escrow Agent. Actions by Escrow Agent.
