Common use of Actions in Concert Clause in Contracts

Actions in Concert. Notwithstanding anything herein or in the other Loan Documents to the contrary, each Lender hereby agrees with each other Lender that no Lender shall take any action to protect or enforce its rights against any Loan Party arising out of this Agreement or any other Loan Document (including exercising any rights of setoff) without first obtaining the prior written consent of the Administrative Agent or the Required Lenders, it being the intent of the Lenders that any such action to protect or enforce rights under this Agreement and the other Loan Documents shall be taken in concert and at the direction or with the consent of the Administrative Agent or the Required Lenders.

Actions in Concert. Notwithstanding anything herein or Anything in the other Loan Documents this Agreement to the contrarycontrary notwithstanding, each Lender hereby agrees with Agent and each other Lender that no Lender shall take any action to protect or enforce its rights against any Loan Party arising out of this Agreement or any the other Loan Document Financing Agreements (including excluding exercising any rights of setoff) without first obtaining the prior written consent of the Administrative Agent or the Required and all other Lenders, it being the intent of the Lenders that any such action to protect or enforce rights under this Agreement and the other Loan Documents Financing Agreements shall be taken in concert and at the direction or with the consent of the Administrative Agent Agent, all Lenders, affected Lenders or the Required Lenders, as the case may be.

Notwithstanding anything herein or in the other Loan Documents to the contrary, but in any event subject to the provisions of subsections 10.4 and 10.5, each Lender hereby agrees with each other Lender that no Lender shall take any action to protect or enforce its rights against any Loan Party Obligor arising out of this Agreement or any other Loan Document (including excluding exercising any rights of setoffsetoff in the case of any Lender that is not a Non-Funding Lender) without first obtaining the prior written consent of the Administrative Agent or the Required Requisite Lenders, it being the intent of the Lenders that any such action to protect or enforce rights under this Agreement and the other Loan Documents shall be taken in concert and at the direction or with the consent of the Administrative Agent or the Required Requisite Lenders.
