Common use of Acts of Securityholders Clause in Contracts

Acts of Securityholders. Except as otherwise specifically provided herein, whenever Securityholder action, consent or approval is required under this Agreement, such action, consent or approval shall be deemed to have been taken or given on behalf of, and shall be binding upon, all Securityholders if the Majority Securityholders agree to take such action or give such consent or approval.

Acts of Securityholders. Except as otherwise specifically provided hereinherein and except with respect to Section 11.02(b), whenever Securityholder action, consent or approval of the Securityholders is required under this Agreement, such action, consent or approval shall be deemed to have been taken or given on behalf of, and shall be binding upon, all Securityholders if the Majority Securityholders Noteholders agree to take such action or give such consent or approval.

Acts of Securityholders. Except as otherwise specifically provided herein, whenever Securityholder action, consent or approval is required under this Agreement, such action, consent or approval shall be deemed to have been taken or given on behalf of, and shall be binding upon, all Securityholders if the Majority Securityholders agree to take such action or give such consent or approval; provided, however, that so long as no Insurer Default has occurred and is continuing any action, consent or approval required under this Agreement by the Securityholders will instead be taken or given by the Insurer.

Except as otherwise specifically provided herein, whenever Securityholder action, consent or approval is required under this Agreement, such action, consent or approval shall be deemed to have been taken or given on behalf of, and shall be binding upon, all Securityholders if the Majority Securityholders agree to take such action or give such consent or approval; provided, however, that so long as the Class A Notes are Outstanding and no Insurer Default has occurred and is continuing any action, consent or approval required under this Agreement by the Securityholders will instead be taken or given by the Insurer.
