Common use of Actual Damages for Late Final Completion Clause in Contracts

Actual Damages for Late Final Completion. After Substantial Completion is achieved, actual damages will be assessed for failure to achieve Final Completion by the Guaranteed Completion Date for Final Completion. Actual damages will be calculated on the basis of direct consultant, administrative, and other related costs attributable to the Project as a result of such failure.
