Additional Batches. If Onyx requests pursuant to Section 5.2(c) that XOMA manufacture additional Batches of Drug Substance in addition to the minimum annual Batch commitment in Sections 5.2(b), XOMA will charge Onyx for these additional Batches at [*] of XOMA's standard manufacturing cost therefor, plus an amount equal to [*] of the difference between [*] and [*] of such standard manufacturing costs (provided that such number is equal to or less than [*]), but in no event will XOMA charge Onyx, or Onyx be obligated to pay, any amounts for such Batches in excess of the per-Batch charge to Onyx set forth in this Section 6.6(b), as adjusted pursuant to Section 6.6(c). For purposes of example: If XOMA's standard manufacturing costs for an additional Batch were [*], then Onyx would pay [*] for such Batch, calculated as follows: [*];
Additional Batches. XOMA will fulfill purchase orders submitted by Onyx in accordance with Section 5.3 for Batches in excess of Onyx's minimum commitments pursuant to this Section 5.2, up to a maximum of the normal and commercially reasonable capacity of the Suite (which the Parties agree is at least [*] Batches per year).

Additional Batches. The manufacture of Batches beyond the amounts set forth in Cytogen's firm orders in Section 2.5(a) (each an "Additional Batch") shall be undertaken only with the agreement of BMS, which agreement shall not be unreasonably withheld. Cytogen shall pay BMS an amount equal to $[**] for each Additional Batch manufactured at Cytogen's request. Upon each anniversary of this Agreement, the price for each Additional Batch shall be increased in accordance with the COM as set forth in Section 3.1(d). BMS will invoice Cytogen following the manufacturing and release of each Additional Batch. Such payments shall be due and payable net thirty (30) days post Cytogen's receipt of invoice.
Additional Batches. The manufacture of Batches beyond the commitment of DuPont set forth in Section 2.1 (each an "Additional Batch") shall be undertaken only with the agreement of DuPont. In the first year of this Agreement, Berlex shall pay DuPont an amount equal to $[**] for each Additional Batch manufactured at Berlex's request. In the following years, Berlex shall pay DuPont an amount per Batch based on the monthly costs as set forth on Exhibit A. Payments under this Section 3.2 shall be due and payable within thirty (30) days following the end of the month during which the Additional Batch was manufactured.
