Common use of ADDITIONAL CLOSING RIGHTS Clause in Contracts

ADDITIONAL CLOSING RIGHTS. We may also close your Account on fourteen (14) days’ notice in the circumstances set out below: The relevant circumstances are: a. Any litigation is commenced involving both of us in an adversarial position to each other and, in view of the subject matter of or any issues in dispute in relation to that litigation, we reasonably decide that we cannot continue to deal with you while the litigation is pending; b. Where you have persistently acted in an abusive manner toward our staff (for example by displaying what we consider to be serious discourtesy or the use of offensive or insulting language); c. Where we believe on reasonable grounds that you are unable to manage the risks that arise from your trades. If we rely on our rights under this clause, your Account will be suspended during the fourteen (14) day notice period and you will not be able to place trades other than those to close existing open Positions. If you have not closed all the open Positions within the fourteen (14) days’ notice we are entitled to take any action within Clause 15.2 of this Client Agreement.
