Common use of Additional Conditions to Incremental Facility Clause in Contracts

Additional Conditions to Incremental Facility. If an Additional Loan is requested, all conditions set forth in Section 2.5 shall have been satisfied. Each request for an Extension of Credit and each acceptance by the Borrower of any such Extension of Credit shall be deemed to constitute representations and warranties by the Credit Parties as of the date of such Extension of Credit that the conditions set forth above in paragraphs (a) through (c) and in paragraph (d), (e), (f) or (g), as applicable, have been satisfied.

Each request for an Extension of Credit and each acceptance by the Borrower Borrowers of any such Extension of Credit (other than the obligation of each Lender to fund its portion of a Mandatory LOC Borrowing or a Mandatory Swingline Borrowing, which shall be governed by the terms of Section 2.2 and Section 2.3, respectively) shall be deemed to constitute representations and warranties by the Credit Parties Borrowers as of the date of such Extension of Credit that the applicable conditions set forth above in paragraphs (a) through (cg) and in paragraph (d), (e), (f) or (g), as applicable, of this Section have been satisfied.
