ADDITIONAL CONTINGENCIES: PHASE I ENVIRONMENTAL REPORT. Lessor, at Lessor's sole cost and expense, shall deliver to Lessee within forty-five (45) days of the Lease Commencement Date, a Phase I Environmental Report as prepared by a qualified environmental firm concerning the subject property. This document shall be in conformance with the American Society for Testing and Materials (ASTM E1527-97) standards. Not later than fifteen (15) days nor sooner than thirty (30) days prior to the expiration or sooner termination of the lease, Lessee, at Lessee's sole cost and expense, will provide to Lessor a Phase I Environmental Report concerning the property. 58.1 The report will be current as of a date not more than fifteen (15) days before the expiration or sooner termination of the lease. Lessee shall pay for costs of the Phase I Environmental Report except in the event the Phase I Environmental Report indicated a condition which required remediation and which TPF: April 29,2002 INITIALS: /s/ ML /s/ JK /s/ DK /s/ CG ------------- ------------- condition was the responsibility of the Lessor. The purpose of the Phase I Environmental Report is to determine and provide evidence that Lessee has complied with all applicable laws, ordinances, rules and regulations of any governmental agency having jurisdiction concerning the use, storage and/or disposition of Hazardous Substances on the leased property during the Term of the lease and/or any extension thereof.
