Additional Fundamental Terms and Conditions. All provisions stated under “ARTICLE X”, “Covenants Subsequent to the Date of Closing”, are herewith incorporated in this Section as fundamental terms and conditions of the Agreement in addition to those stated in “ARTICLE I” and shall remain obligations of the respective parties hereto, and shall continue post-Closing per Section 12.15, “Survival of Terms and Conditions.”
