Additional Issuer. SECTION 101
Additional Issuer. Any Person may become an Issuer hereunder, jointly and severally with ETrans LLC, upon execution and delivery to the Trustee of a supplemental indenture substantially in the form of Exhibit A hereto. Upon execution and delivery of such supplemental indenture, such Person shall become an Issuer hereunder with the following effect: (1) All references herein to the Issuer shall also include such Person; and (2) Such Person shall observe and perform the covenants and agreements contained herein without regard to the performance and satisfaction by ETrans LLC of the covenants and agreements contained herein, except that the payment of any amount due on any Security or other amount hereunder shall be satisfied if made by any Issuer.
Additional Issuer. The Note Parties will cause each Additional Issuer to execute a counterpart to this Agreement in the form attached hereto as Exhibit D and to deliver such counterpart to the Purchasers substantially concurrently with execution of such Additional Issuer of the supplemental indenture pursuant to which it shall have become an Additional Issuer.
