Common use of Additional Issuing Lenders Clause in Contracts

Additional Issuing Lenders. The Borrower may, at any time and from time to time with the consent of the Administrative Agent (which consent shall not be unreasonably withheld, conditioned or delayed) and such Lender or Lenders, as applicable, designate one or more additional Lenders to act as a Letter of Credit issuing bank under the terms of this Agreement. Any Lender designated as a Letter of Credit issuing bank pursuant to this paragraph shall be deemed to be an “Issuing Lender” (in addition to being a Lender) in respect of Letters of Credit issued or to be issued by such Lxxxxx, and, with respect to such Letters of Credit, such term shall thereafter apply to the other Issuing Lenders and such Lender.

Any Lender who shall so agree to be designated as a Letter of Credit an issuing bank pursuant to this paragraph shall be deemed to be an “Issuing Lender” (in addition to being a Lender) in respect of Letters of Credit issued or to be issued by such Lxxxxx, and, with respect to such Letters of Credit. For the avoidance of doubt, such term none of HPS, any HPS Lender, WhiteHorse or any WhiteHorse Lender shall thereafter apply be obligated to the other act as an Issuing Lenders and such Lender.

Any Lender designated as a Letter of Credit issuing bank pursuant to this paragraph shall be deemed to be an “Issuing Lender” (in addition to being a Lender) in respect of Letters of Credit issued or to be issued by such LxxxxxLender, and, with respect to such Letters of Credit, such term shall thereafter apply to the other Issuing Lenders Lender and such Lender.
