Common use of Additional Lender or Lenders Clause in Contracts

Additional Lender or Lenders. If any Lender does not deliver an Extension Consent as provided in Section 3.13(i), upon the expiration of the Commitment of such Lender, or upon its termination as provided in Section 3.13(iv), the Borrower may with the approval of the Administrative Agent amend this Agreement as provided in Section 13.02 and 13.06 to add one or more other Lenders as parties, with such Commitment or Commitments as may be agreed to by the Administrative Agent and such other Lender or Lenders; provided that such additions do not increase the aggregate amount of the Commitments to an amount greater than the aggregate amount of Commitments in effect immediately before such expiration or termination.

If any Lender does not deliver an Extension Consent as provided in Section 3.13(i2.1(g), upon the expiration of the Commitment of such Lender, or upon its termination as provided in Section 3.13(ivSubsection 2.1(j), the Borrower may with the approval of the Administrative Agent amend this Agreement as provided in Section 13.02 Subsections 10.3 and 13.06 10.6 to add one or more other Lenders as parties, with such Commitment or Commitments as may be agreed to by the Administrative Agent and such other Lender or Lenders; , provided that such additions do not increase the aggregate amount of the Commitments to an amount greater than the aggregate amount of Commitments in effect immediately before such expiration or termination.

If any Lender does not deliver an Extension Consent as provided in Section 3.13(i4.02(b), upon the expiration of the Commitment of such Lender, or upon its termination as provided in Section 3.13(iv4.02(d), the Borrower may with the approval of the Administrative Agent amend this Agreement as provided in Section 13.02 and 13.06 herein to add one or more other Lenders (each an “Additional Commitment Lender”) as parties, with such Commitment or Commitments as may be agreed to by the Administrative Agent and such other Lender or Lenders; provided that such additions do not increase the aggregate amount of the Commitments Aggregate Committed Amount to an amount greater than the aggregate amount of Commitments in effect immediately before such expiration or termination.
