ADDITIONAL PURCHASE NOTICES. If the Company has delivered a Mandatory Purchase Notice relating to an Investment Period, the Chief Financial Officer (or such other person as designated in writing) of the Company may, in the Company's sole discretion, deliver an Additional Purchase Notice to the Investor on or before the third (3rd) Trading Day preceding the commencement of the Investment Period (each such notice being an "Additional Purchase Notice"), stating the Additional Amount which the Investor shall be required to purchase during such Investment Period (in addition to the amount representing the Minimum Obligation). Each Additional Purchase Notice shall be irrevocable. An Additional Purchase Notice may not be delivered if the Company has not delivered a Mandatory Purchase Notice with respect to the same Investment Period.
ADDITIONAL PURCHASE NOTICES. Unless the Company has delivered a Cancellation Notice relating to an Investment Period, the Chief Executive Officer or the Senior Vice President (or such other person as designated by either in writing) of the Company may, in the Company's sole discretion, deliver an Additional Purchase Notice to the Investor on or before the twentieth (20th) day preceding the commencement of the Investment Period (each such notice being an "Additional Purchase Notice"), stating the Additional Amount which the Investor shall be required to purchase during such Investment Period (in addition to shares of Common Stock representing the Minimum Obligation). Each Additional Purchase Notice shall be irrevocable. An Additional Purchase Notice may not be delivered if the Company has delivered a Cancellation Notice with respect to the same Investment Period.
ADDITIONAL PURCHASE NOTICES. Upon the terms and conditions set forth herein (including, without limitation, the provisions of Article VII), at any time following three (3) Business Days following the Initial Purchase Date (unless waived by the Investor), the Company shall have the right, but not the obligation, to require the Investor, by its delivery to the Investor of a Purchase Notice from time to time, to purchase Purchase Notice Shares provided that the amount of Purchase Notice Shares shall not exceed the Purchase Notice Limit or the Beneficial Ownership Limitation set forth in Section 7.2(g) (each such purchase, a “Closing”). The Company may not deliver a subsequent Purchase Notice until the Closing of an active Purchase Notice, except if waived by the Investor in writing. Furthermore, the Company shall not deliver any Purchase Notices to the Investor during the PEA Period. Notwithstanding the foregoing, the Company may not submit a Purchase Notice to the Investor if the Purchase Amount is less than $10,000.
