Address for Notice Purposes. 10.1 The parties choose the address for the purposes of the giving of any notice, the serving of any process and for any other purposes arising from this Agreement at: Seller: c/o Miller Xxxxxx Le Roux Hill Inc., Parc du Links, 0 Xxxxxxx Xxx, Xxxxxxxx Xxxx, 0000, contact number 000 000 0000, fax number 021 840 8044, Email: xxxx@xxxx.xx.xx Purchaser: As per Annexure A 10.2 The parties shall be entitled from time to time, by written notice to the other to vary its domicilium to any other address within the Republic of South Africa which is not a post office box or post restante. 10.3 Notice given and any payment made by a party to any of the other ("the addressee") which: 10.3.1 is delivered by prepaid registered post from an address within the Republic of South Africa to the addressee at the addressee's domicilium for the time being shall be presumed, unless the contrary is proved by the addressee, to have been received by the addressee on the fourth day after the date of posting; 10.3.2 is transmitted by telefax during normal business hours of the addressee shall be presumed, unless the contrary is proved by the addressee, to have been received by the addressee within one hour after receipt of transmission; 10.3.3 by e-mail to the address chosen by the party concerned, in which event it shall be deemed to have been received, unless the contrary is proved within 24 (twenty four) hours of transmission. 10.4 Notwithstanding the provisions of clauses 10.3.1 to 10.3.3 in the event that a written notice or any process is actually received by a party, such receipt shall be valid for all purposes under this agreement notwithstanding that it was not received at a party's chosen domicilium.
