ADEQUATE RESOURCES TO PERFORM Clause Samples

The "Adequate Resources to Perform" clause requires a party, typically a contractor or service provider, to ensure that it has sufficient personnel, equipment, and financial means to fulfill its obligations under the agreement. In practice, this means the party must maintain the necessary staff, tools, and funding throughout the contract term to deliver the agreed-upon goods or services without interruption. This clause helps prevent delays or failures in performance by obligating the responsible party to be properly prepared and resourced, thereby reducing the risk of non-performance for the other party.
ADEQUATE RESOURCES TO PERFORM. Pursuant to the Purchase Order for the applicable Purchaser facility, Contractor must have sufficient equipment/tools and personnel to perform the Janitorial Services as set forth in this Master Contract and the applicable Purchase Order. Unless otherwise agreed in the applicable Purchase Order, Contractor, including sufficient personnel, must be available twenty-four (24) hours per day, seven (7) days per week, and three hundred sixty-five (365) days per year (24/7/365), including all weekends and holidays observed by the federal, state, and county governments and/or Contractor.
