Common use of Adjudication Action Clause in Contracts

Adjudication Action. Following the Effective Date, BWD will file the Adjudication Action in the Superior Court for the County of San Diego on or before January 24, 2020, subject to extension for reasonable delay beyond the control of the BWD. The Adjudication Action is to comprehensively determine and adjudicate all Groundwater rights in the Basin and provide a physical solution for the perpetual and continuous management of the Basin, which perpetual management will achieve Sustainable Groundwater Management for the Basin consistent with the substantive objectives of SGMA and with the reasonable and beneficial use doctrine under Article X, section 2 of the California Constitution.
