Adjusted Amount and no Adjusted Amount. Office of Rail and Road’s refusal of consent (a) require the parties again to follow the procedure or any part of the procedure set out in Clauses 16.4.1 to 16.4.5 for agreeing the Adjusted Amount, in which case they shall do so; or (b) following such consultation with the parties as it considers necessary, determine the Adjusted Amount itself and give a notice specifying such Adjusted Amount.
