Adjustment for Aggregate Limit. If, after the correction of excess contributions (if any) pursuant to Section 3.3.3 and of excess Matching Contributions pursuant to Section 3.4.3, both the average deferral percentage and the contribution percentage for Section 401(k) Members who are Highly Compensated Employees for the Plan Year are more than one and one-quarter (1-1/4) times the corresponding percentage for Section 401(k) Members who are not Highly Compensated Employees for the Applicable Plan Year, the Elective Contributions for Section 401(k) Members who are Highly Compensated Employees shall be reduced in the manner described in Section 3.3.3 to the extent necessary to cause the sum of such percentages for Section 401(k) Members who are Highly Compensated Employees not to exceed the aggregate limit set forth in Section 3.5.3. The amount of any such reduction in Elective Contributions shall be adjusted in accordance with regulations for income or loss attributable thereto for the Plan Year for which such amount was paid into the Plan, and shall be distributed within the period and in the manner set forth in Section 3.3.3.
