Adjustment for NY Public Policy Transmission Costs. Municipality understands that for any supply to Participating Customers the Fixed Price includes NY Public Policy Transmission Costs at a rate of $0.00440/kWh. Rates for NY Tier 2 REC Program Costs and additional transmission charges as may be assessed by New York State pursuant to the “Order Approving Phase 2 Areas Of Concern Transmission Upgrades” issued by the PSC on February 16, 2023 (“NY CFC Transmission Costs”) are unknown at the time of bidding and therefore are not included in the Fixed Price. Competitive Supplier will pass through to Participating Customers any future changes, (upward or downward) to such costs, based on changes in such costs during the remainder of term of this ESA, and which will be reflected in a future adjustment. Any such adjustments shall occur once during any calendar year.
