Common use of Adjustment of Restrictions Clause in Contracts

Adjustment of Restrictions. Despite the prior provisions of this Section 12, if any covenant or agreement contained in Sections 2, 10 or 11, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.

Adjustment of Restrictions. Despite the prior provisions of this Section 1211, if any covenant or agreement contained in Sections 2, 10 or 11Section 10, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision or the geographic area covered therebyprovision, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.

Despite the prior provisions of this Section 1211, if any covenant or agreement contained in Sections 2, 10 8.4 or 1110, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.

Despite the prior provisions of this Section 1213, if any covenant or agreement contained in Sections 2, 10 Section 12 or 1113, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.

Despite the prior provisions of this Section 1214, if any covenant or agreement contained in Sections 2, 10 Section 12 or 1113, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.

Despite the prior provisions of this Section 12, if any covenant or agreement contained in Sections 28.4, 10 or 11, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.
