Common use of Adjustment of Restrictions Clause in Contracts

Adjustment of Restrictions. Despite the prior provisions of this Section 11, if any covenant or agreement contained in Section 10, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision, the court making such determination shall have the power to reduce the duration of such provision and, in its reduced form, such provision shall be enforceable.

Adjustment of Restrictions. Despite the prior provisions of this Section 11, if any covenant or agreement contained in Section Sections 8.4 or 10, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provisionprovision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, such provision shall be enforceable.

Adjustment of Restrictions. Despite the prior provisions of this Section 1112, if any covenant or agreement contained in Section 10Sections 2, 10 or 11, or any part thereof, thereof is held by any court of competent jurisdiction to be unenforceable because of the duration of such provisionprovision or the geographic area covered thereby, the court making such determination shall have the power to reduce the duration or geographic area of such provision and, in its reduced form, form such provision shall be enforceable.

Despite the prior provisions of this Section 119, if any covenant or agreement contained in Section 108, or any part thereof, is held by any court of competent jurisdiction to be unenforceable because of the duration of such provision, the court making such determination shall have the power to reduce the duration of such provision and, in its reduced form, such provision shall be enforceable.
