Administrative Agent Rights Under the Agreement. The Administrative Agent’s rights and remedies under this Agreement shall be in addition to and not in limitation of all rights and remedies of the Administrative Agent under the Credit Agreement or any of the other Loan Documents. Payments, if any, by the Indemnitors as required under this Agreement shall not reduce the Indemnitors’ obligations and liabilities under any of the Loan Documents. Any default by an Indemnitor under this Agreement (including any breach of any representation or warranty made by each Indemnitor) shall, at the Administrative Agent’s option, constitute a default and an Event of Default (“Event of Default”) under the Credit Agreement, the Note and/or any of the other Loan Documents after the expiration of any applicable cure period.
