ADMINISTRATIVE LIABILITY. The User declares that it is aware of the applicable legislation on the administrative liability of legal persons, with particular regard to Legislative Decree no .231 of 8 June 2001, and that it has viewed the document entitled “Model 231”, which also includes the Code of Ethics which the Operating Company drafted with reference to the applicable legislation on administrative wrongdoings by legal persons arising from crimes committed by directors, employees and/or collaborators. Model 231 is available on the website of the Operating Company. Moreover, the User may ask the Operating Company to provide it with a hard copy at any time.
ADMINISTRATIVE LIABILITY. The Supplier declares to be aware of the provisions of the Legislative Decree dated 8 June 2001 n. 231, and subsequent additions, as well as the rules of the "Code of Ethics and Conduct" and those provided by the "Model 231" of OLT, as well as the contents of the "Charter of Values", the "Major Accident Prevention Policy" and "HQSE Policy" of OLT (published on the website xxx.xxxxxxxxxxx.xx and in any case already made available to the Company) in relation to the activities envisaged by this appointment and which the Seller intends to fully observe. The Supplier, therefore, undertakes to behave in line with the aforementioned Code of Ethics and with the Organizational Model, for the applicable parts, and in any case such as not to expose the Seller to the risk of applying the sanctions provided for by the aforementioned Legislative Decree 231 / 2001, it being understood that compliance with the principles contained therein is essential for OLT.
ADMINISTRATIVE LIABILITY. 1. The Shipper declares to know, and undertakes to respect, the Anti-corruption Laws, Code of Ethics and the “231 Model” of Snam Rete Gas (available and printable on website xxx.xxxxxxxxxxx.xx) and the Anti-corruption Procedure of SNAM (available and printable on website xxx.xxxx.xx).
2. With reference to the execution of activities covered by this Agreement, the Shipper agrees on:
a. to abstain from giving or promising money, commissions, fees and other benefits to the Boards, the employees or associates of Snam and / or its subsidiaries, including gifts, entertainment, travel or any other type of benefit, even non-pecuniary, beyond the limits that are allowed by the Code of Ethics of Snam Rete Gas and the Anti-corruption Procedure of SNAM;
b. to communicate in any case without undue delay any request or demand or attempted payment or promise of what is mentioned into sub-paragraph (a), independently of any assessment of the conformity of the Code of Ethics of Snam Rete Gas and the "Anti-Corruption Procedures" of SNAM;
c. to refrain from concluding agreements directly with SNAM Group staff or their family members or companies related to them. These communication should be sent to the mailbox xxxxxxxxxxxx@xxxx.xx.
ADMINISTRATIVE LIABILITY. The Supplier declares that has read and is familiar with the contents of Form 231 of SRG and OLT, which also includes their respective Codes of Ethics, developed by SRG and OLT in reference to the current legislation on administrative offences of legal persons dependent on the offence committed by directors, employees and/or collaborators available on the websites xxx.xxxxxxxxxxx.xx and xxx.xxxxxxxxxxx.xx (hereinafter referred to as the "Regulations"). With reference to the execution of activities under this Contract, the Supplier states and guarantees they have instructed and implemented provisions with respect to their directors, employees and/or associates to prevent the commission of, or attempts at, behaviour sanctioned by the Regulations and agrees, with respect to SRG and OLT, to keep all these provisions effectively implemented for the entire term of this Contract. In particular and in accordance with these regulations, the Supplier undertakes to refrain (and to ensure that their directors, employees and/or associates abstain) from offering, promising, donating, paying or accepting, directly or indirectly, any request for gifts from a public official or any private entity, or from authorising anyone to donate or pay, directly or indirectly, any sum of money, utility, benefit, advantage whatsoever, or anything of value to a public official or any private entity. For the purposes of this Contract, a public official shall mean:
a) anyone holding a public office with a legislative, judicial or administrative function;
b) any other person acting in an official capacity in behalf of, for or on behalf of (i) a supranational, national, regional or local public administration, (ii) an agency, department, office, or a supra national, regional or local organ of public administration, (iii) a corporation owned, controlled or partly owned by an organ of public administration, (iv) a public international organisation, and or (v) a political party, a member of a political party or a candidate for political office; Courtesy English Translation not binding – only the Italian version is binding)
c) any employee of a public service;
d) any other entity, natural person or entity, that acts at the suggestion, request or provision of or for the benefit of any of the persons or entities referred to in points a) to c) above.

ADMINISTRATIVE LIABILITY. The TRADER declares that it knows, and undertakes to comply with Anti-Corruption Laws, the Code of Ethics and the “231 Model” of Snam Rete Gas S.p.a. (available for consultation and printing at the website xxx.xxxxxxxxxxx.xx) and SNAM’s “Anti-corruption Procedure” (available for consultation and printing at the website xxx.xxxx.xx). With reference to the execution of the activities of the present Agreement, the TRADER undertakes:
a. to refrain from giving or promising money, commissions, emoluments and other utilities to directors, statutory auditors, employees or contractors of Snam and/or Subsidiaries, including gifts, entertainment, trips or any other type of benefit, including non-pecuniary ones, beyond the limits allowed by the Code of Ethics of Snam Rete Gas S.p.A. and by the SNAM “Anti-corruption Procedure”;
b. in any case to communicate without delay any request or attempted request or transfer or promise of what is indicated in (a) above, regardless of any assessment of compliance with the Code of Ethics of Snam Rete Gas S.p.A. and with the SNAM “Anti-corruption Procedure”;

ADMINISTRATIVE LIABILITY. No officer, agent, or employee of the City of Xxxxxx shall render himself personally liable for any damage that may occur to persons or property as a result of any act required or permitted in the discharge of his duties under this Chapter. Any suit brought against any officer, agent or employee of the City of Jasper as a result of any act required or permitted in the discharge of his duties under this Chapter shall be defended by the City Attorney until the final determination of the proceeding therein. ADMINISTRATIVE LIABILITY. 9.1 The Seller declares that it has examined and is fully aware of the content of the OLT Model 231, including the Code of Ethics, prepared by OLT in compliance with current regulations on administrative offences of a legal entity due to crimes committed by directors, employees and/or collaborators and made available on its website (xxx.xxxxxxxxxxx.xx). With reference to the execution of the activities covered by this Contract, the Seller declares and guarantees that it has imparted and implemented provisions to its directors, employees and/or collaborators designed to prevent the conduct punished by the Regulations from being committed or even attempted and is obliged, on behalf of SRG and OLT, to keep all these provisions effectively implemented for the whole duration of this Contract. In particular, and in line with these regulations, the Seller undertakes to abstain (and see that its directors, employees and/or collaborators abstain) from offering, promising, bestowing, paying or accepting, directly or indirectly, any request for gifts from a Public Official or any private individual, or authorizing anyone to bestow or pay, directly or indirectly, any sum of money, asset, benefit of any kind or anything of value in favour of a Public Official or any private individual. For the purposes of this Contract, Public Official means:
a) anyone who holds a public office or function in a legislative, judicial or administrative capacity;
b) whoever acts in an official capacity on behalf of or in the interest of (i) a supranational, national, regional or local public administration, (ii) an agency, department, office or body of a supranational, national, regional or local public administration, (iii) a firm owned, controlled or in which a public administration has a shareholding, (iv) and international public organization and/or
ADMINISTRATIVE LIABILITY. Administrative liability occurs for violations against the license and result in penalties such as suspension of license privileges, imposition of certain conditions, and revocation of a license. The purpose of these penalties is not to punish, but instead to deter licensee’s using license privileges in ways contrary to law and that puts the community’s health, safety, and welfare at risk.

c) engaging in business activities or entering into agreements with third parties in violation of the principles of the Code of Ethics which may adversely affect the performance of this Contract;
d) providing directors, auditors, employees or consultants of SRG and OLT with non- pecuniary benefits or any other benefit, even in the form of gifts, provision of means of transport, offers of hospitality, not contained within the limits of what is normally allowed by the common standards of business ethics.
ADMINISTRATIVE LIABILITY. No officer, agent, or employee of the City of Jasper, Indiana, shall render themselves personally liable for any damage that may occur to persons or property, as a result of any act required or permitted in the discharge of their duties under this chapter. Any suit brought against any officer, agent, or employee of the City of Jasper, Indiana, as a result of any act required or permitted in the discharge of their duties under this chapter, shall be defended by the City Attorney until the final determination of the proceedings therein.
