Common use of Administrators and Affiliates Clause in Contracts

Administrators and Affiliates. Each of the Lenders, the Group Agents and the Administrator and any of their respective Affiliates may extend credit to, accept deposits from and generally engage in any kind of banking, trust, debt, entity or other business with the Borrower, CB, the Servicer or any Originator or any of their Affiliates. With respect to any funding of the Eligible Receivables pursuant to this Agreement, each of the Group Agents and the Administrator shall have the same rights and powers under this Agreement as any Lender and may exercise the same as though it were not such an agent, and the terms “Lender” and “Lenders” shall include, to the extent applicable, each of the Group Agents and the Administrator in their individual capacities.

With respect to any funding the acquisition of the Eligible Receivables pursuant to this Agreement, each of the Group Purchaser Agents and the Administrator shall have the same rights and powers under this Agreement as any Lender Purchaser and may exercise the same as though it were not such an agent, and the terms “LenderPurchaser” and “LendersPurchasers” shall include, to the extent applicable, each of the Group Purchaser Agents and the Administrator in their individual capacities.
