Common use of Advance Payments of Long Term Disability Clause in Contracts

Advance Payments of Long Term Disability. During the first month in which an employee who is eligible and has applied for Long Term Disability Benefits, the Employer shall, on written request by the Employee, advance to the employee the amount of money which the employee is entitled to receive from the LTD Plan. Such advance payment shall be refunded to the Employer by the employee following the employee’s return to work on a normal basis, or earlier at the employee’s option. The repayment will be made over a 6 (six) month period and can be made by cheque, by utilizing vacation overtime or RWWL days, or a combination thereof. If the employee terminates employment, such advance payment shall be deducted from the final pay, if any, paid by the Employer to the employee, otherwise the Employer shall have the right to seek reimbursement through legal action.
