Common use of Advances by the Servicer Clause in Contracts

Advances by the Servicer. (a) By the close of business on the day required by Section 5.02, the Servicer shall deposit into the Collection Account, out of its own funds, the related Advance. (b) On each Payment Date, the Servicer shall reimburse itself for the Outstanding Amount Advanced to the extent of actual collections of late scheduled payments. (c) If the Servicer determines that any advance made pursuant to this Section 5.11 has become a Nonrecoverable Advance and at the time of such determination there exists an Outstanding Amount Advanced, then the Servicer shall reimburse itself out of funds in the Collection Account for the amount of such Nonrecoverable Advance, but only to the extent of such Outstanding Amount Advanced.

(b) On each Payment Distribution Date, the Servicer shall reimburse itself for the Outstanding Amount Advanced to the extent of actual collections of late scheduled payments. (c) If the Servicer determines that any advance Advance made pursuant to this Section 5.11 5.09 has become a Nonrecoverable Advance and at the time of such determination there exists an Outstanding Amount Advanced, then the Servicer shall reimburse itself out of funds in the Collection Account for the amount of such Nonrecoverable Advance, but only to the extent of such Outstanding Amount Advanced.
