Common use of Advances Do Not Constitute a Waiver Clause in Contracts

Advances Do Not Constitute a Waiver. No Advance made by the Banks shall constitute a waiver of any of the conditions to the Banks' obligation to make further Advances nor, in the event the Borrower fails to satisfy any such condition, shall any such Advance have the effect of precluding the Banks from thereafter declaring such failure to satisfy a condition to be an Event of Default.
