Adverse Possession - Tacking Sample Clauses

Adverse Possession - Tacking. In the event that Xxxxxx is found not to have had fee simple title when he conveyed the parcel to Xxxx, Xxx has a strong adverse possession claim to the parcel. Xxxx obtained a deed for a fee simple absolute to the parcel in May 1988 and occupied it under color of title. Xxx occupied the parcel, also under color of title, until at least September 1, 1999. The parcel is accessible only during summer months, and it has been occupied every summer for more than 10 years by parties who claim ownership hostile to Ed. Xxx’s occupation, tacked onto Xxxx’x occupation, is enough to establish title by adverse possession. It should be noted that title by adverse possession alone is not enough to establish marketable title. Should Xxx’s claim to title by deed fail, he would be unable to satisfy Xxxx’s demand for marketable title and therefore would not be entitled to remedies.
