Common use of Affidavit Required Clause in Contracts

Affidavit Required. CMR shall provide at Substantial Completion, a notarized certification statement in accordance with Tex. Admin. Code, Rule § 295.34(c) (1) certifying that no ACBM was used during construction of the Project. Prior to submitting this affidavit, every Subcontractor and supplier shall have provided a notarized statement to CMR that no ACBM has been provided, used, or left on this Project (which shall be provided to TFC upon request). CMR shall take whatever measures that may be necessary to insure that all employees, suppliers, fabricators, material men, subcontractors, or their assigns comply with this requirement.
