Common use of Affirmation and Acceptance of Agreements and Findings of Benefit Clause in Contracts

Affirmation and Acceptance of Agreements and Findings of Benefit. Landowner hereby ratifies, confirms, accepts, agrees to, and approves: (i) the creation and boundaries of the District, and the boundaries of the Landowner’s Parcel and the location and development of the Phase #3 Improvements on the Landowner’s Parcel and on the property within Phase #3 of the District; (ii) the determinations and findings as to the benefits by the City Council in the Service and Assessment Plan and the Assessment Ordinance; and (iii) the Assessment Ordinance and the Service and Assessment Plan.

Landowner hereby ratifies, confirms, accepts, agrees to, and approves: (i) the creation and boundaries of the District, and the boundaries of the Landowner’s Parcel which are coterminous with the District, all as shown on Exhibit I, and the location and development of the Phase #3 Authorized Improvements on the Landowner’s Landowner Parcel and on the property within Phase #3 of the District; (ii) the determinations and findings as to the benefits by the City Council in the Service and Assessment Plan and the Assessment Ordinance; and (iii) the Assessment Ordinance and the Service and Assessment Plan.
