Common use of Affirmative Obligation Clause in Contracts

Affirmative Obligation. Contractor’s defense, indemnification and hold harmless obligations to any Indemnified Party will remain an affirmative obligation of Contractor unless and until a court of competent jurisdiction finally determines otherwise and all opportunities for appeal have been exhausted or have lapsed.
