Agency and Affiliates. Bank of America, N.A. shall have the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not the Administrative Agent, and Bank of America, N.A. and its affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Borrower, EQR or any Subsidiary or affiliate of the Borrower as if it were not the Administrative Agent hereunder, and the term “Bank” and “Banks” shall include Bank of America, N.A. in its individual capacity.
Agency and Affiliates. Sumitomo Mitsui Banking Corporation has the same rights and powers under this Agreement as any other Lender and may exercise or refrain from exercising the same as though it were not Administrative Agent and Sumitomo Mitsui Banking Corporation and each of its Affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Loan Parties or any Subsidiary or Affiliate of the Loan Parties as if it were not Administrative Agent hereunder, and the term “Lender” and “Lenders” shall include Sumitomo Mitsui Banking Corporation in its individual capacity.
Agency and Affiliates. Bank of America, N.A. and JPMorgan Chase Bank, N.A. shall have the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not the Administrative Agent or Syndication Agent respectively, and Bank of America, N.A., JPMorgan Chase Bank, N.A., and their affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Borrower, EOPT or any Subsidiary or affiliate of the Borrower as if they were not the Administrative Agent and Syndication Agent, respectively, hereunder, and the term “Bank” and “Banks” shall include Bank of America, N.A. and JPMorgan Chase Bank, N.A., in their individual capacities.

PNC shall have the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not the Administrative Agent and PNC and its affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Borrower, CESRRI or any Subsidiary or affiliate of the Borrower as if it was not the Administrative Agent hereunder, and the term "Bank" and "

Wachovia Bank, National Association shall have the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not the Administrative Agent, and Wachovia Bank, National Association and its affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Borrower, EOPT or any Subsidiary or affiliate of the Borrower as if it were not the Administrative Agent hereunder, and the term “Bank” and “Banks” shall include Wachovia Bank, National Association in its individual capacity.

SMBC has the same rights and powers under this Agreement as any other Lender and may exercise or refrain from exercising the same as though it were not Administrative Agent and SMBC and each of its Affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Loan Parties or any Subsidiary or Affiliate of the Loan Parties as if it were not Administrative Agent hereunder, and the term “Lender” and “Lenders” shall include SMBC in its individual capacity.
Agency and Affiliates. JPMorgan Chase Bank, N.A. and Sumitomo Mitsui Banking Corporation each has the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not the Administrative Agent or Syndication Agent, as applicable, and JPMorgan Chase Bank, N.A. and Sumitomo Mitsui Banking Corporation and each of their affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Borrower, General Partner or any Subsidiary or affiliate of the Borrower as if they were not the Administrative Agent or Syndication Agent, as applicable, hereunder, and the term “Bank” and “Banks” shall include each of JPMorgan Chase Bank, N.A. and Sumitomo Mitsui Banking Corporation, each in its individual capacity.

(and any other Bank hereafter acting as Administrative Agent) in its individual capacity.
Agency and Affiliates. KeyBank and Syndication Agent shall have the same rights and powers under this Agreement as any other Lender and may exercise or refrain from exercising the same as though it were not the Administrative Agent, and KeyBank and its affiliates may accept deposits from, lend money to, and generally engage in any kind of business with any Borrower or any Subsidiary or affiliate of any Borrower as if it were not the Administrative Agent hereunder, and the term “Lender” and “Lenders” shall include KeyBank in its individual capacity. Syndication Agent is an agent hereunder in title only and such designation shall impose no obligations on it.
