Common use of AGENCY FEE PAYMENT/DEDUCTION Clause in Contracts

AGENCY FEE PAYMENT/DEDUCTION. All employees who are not members of the Association and who elect not to initiate a voluntary dues deduction authorization form shall pay an agency fee to the Association in an amount determined by the Association and consistent with applicable law. Any dispute between a non-member and the Association over the amount of the agency fee shall be resolved consistent with current law and shall be in accordance with any applicable regulations and decisions of the Public Employment Relations Board (PERB). An agency fee may be paid by an employee submitting a signed agency fee deduction authorization form to the District; or by direct annual payment to the Association by November 1 of any school year; or within sixty (60) days of the first day of employment for new employees; or by involuntary deduction from wages pursuant to Education Code Section 45061.
