Common use of Agent and Affiliates Clause in Contracts

Agent and Affiliates. With respect to the Loans, Agent shall have the same rights and powers hereunder as any other Bank and may exercise the same as though it were not Agent, and Agent and its affiliates may accept deposits from, lend money to and generally engage in any kind of business with any Company or affiliate thereof.

With respect to its Commitments and the LoansLoans made by it in its capacity as a Lender, the entity that is Agent shall have the same rights and powers hereunder under this Agreement and the other Loan Documents as any other Bank Lender and may exercise the same as though it were not Agent, and the entity that is Agent and its affiliates Affiliates may accept deposits from, lend money to and generally engage in any kind of business with Borrower or any Company or affiliate thereofSubsidiary as if it were not Agent.
