Common use of Agent May Perform Clause in Contracts

Agent May Perform. If any Grantor fails to perform any obligation contained in this Agreement, Agent may itself perform, or cause performance of, such obligation, and the expenses of Agent or any other Secured Party incurred in connection therewith shall be jointly and severally payable by the Grantors; provided that Agent or any other Secured Party shall not be required to perform or discharge any obligation of any Grantor.

Agent May Perform. If Upon the occurrence and during the continuance of an Event of Default, if any Grantor fails to perform any agreement contained herein, the Agent may, but without any obligation contained in this Agreementto do so and without notice, Agent may itself perform, or cause performance of, such obligationagreement, and the expenses of the Agent or any other Secured Party incurred in connection therewith shall be jointly and severally payable by the Grantors; provided that Agent or any other Secured Party shall not be required to perform or discharge any obligation of any Grantorsuch Grantor under Section 23.

Agent May Perform. If any the Grantor fails to perform any obligation agreement contained in this Agreementherein, the Agent may itself perform, or cause performance of, such obligationagreement, and the expenses of the Agent or any other Secured Party incurred in connection therewith shall be jointly and severally payable by the Grantors; provided that Agent or any other Secured Party Grantor under section 16(b). The Grantor assumes all liability and responsibility in connection with the Collateral, and the liability of the Grantor to pay the Obligations shall not be required to perform diminished or discharge any obligation otherwise affected by reason of any GrantorCollateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reason.

If any the Grantor fails to perform any obligation contained in this Agreement, the Agent may itself perform, or cause performance of, such obligation, and the costs and expenses of the Agent or any other Secured Party incurred in connection therewith shall be jointly and severally payable by the GrantorsGrantor; provided that the Agent or any other Secured Party shall not be required to perform or discharge any obligation of any Grantorthe Grantor and the performance by the Agent shall not waive the rights of the Agent to enforce this Agreement.

If any the Grantor fails to perform any obligation agreement contained in this Agreementherein, the Agent may may, but shall not be obligated to, itself perform, or cause performance of, such obligationagreement, and the expenses of the Agent or any other Secured Party incurred in connection therewith shall be jointly and severally payable by the Grantors; provided that Agent or any other Secured Party Grantor pursuant to Section 15 hereof or, if not so paid, shall not be required to perform or discharge any obligation of any Grantorbecome Obligations.

Agent May Perform. If any the Grantor fails to perform any obligation contained under or in connection with this Agreement, the Agent may (but shall have no duty to) itself perform, perform or cause performance of, of such obligation, and the expenses of the Agent or any other Secured Party incurred in connection therewith shall be jointly and severally payable by the Grantors; provided that Grantor pursuant to Section 6.4. The Agent or may from time to time take any other Secured Party shall not be required to perform action which the Agent deems necessary or discharge any obligation appropriate for the maintenance, preservation or protection of any Grantorof the Collateral or of its security interest therein.
