Common use of Agents and Affiliates Clause in Contracts

Agents and Affiliates. Each Agent in its individual capacity and not as an Agent hereunder shall have the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not an Agent hereunder and each Agent in its individual capacity and not as an Agent hereunder may accept deposits from, lend money to, and generally engage in any kind of business with any Credit Party and any of their Affiliates as if it were not an Agent hereunder.

Agents and Affiliates. Each Agent of the Agents in its individual capacity and not as an Agent hereunder shall have the same rights and powers under this Agreement the Financing Documents as any other Bank and may exercise or refrain from exercising the same as though it were not an Agent hereunder and each Agent of the Agents in its individual capacity and not as an Agent hereunder their respective Affiliates may accept deposits from, lend money to, and generally engage in any kind of business with the Company or any Credit Party and any Subsidiary or Affiliate of their Affiliates the Company as if it were not an Agent hereunderAgent.
