Common use of Agents in Individual Capacity Clause in Contracts

Agents in Individual Capacity. Each of the Agent and the Collateral Agent and their affiliates may make loans to, accept deposits from and generally engage in any kind of business with the Borrowers as though the Agent and the Collateral Agent were not agents hereunder. With respect to any Note issued to the Lender serving as the Collateral Agent, the Collateral Agent shall have the same rights and powers under this Agreement as a Lender and may exercise such rights and powers as though it were not the Collateral Agent. The terms "Lender" and "Lenders" shall include the Collateral Agent in its individual capacity.
