Common use of Agent’s option Clause in Contracts

Agent’s option. Before an arbitrator has been appointed by a Finance Party to determine a Dispute, the Agent may (and, if so instructed by the Majority Lenders, shall) by notice in writing to the Borrower require that all Disputes or a specific Dispute be heard by a court of law. If the Agent gives such notice, the Dispute to which such notice refers shall be determined in accordance with Clause 10 (Jurisdiction).

Agent’s option. Before an arbitrator has been appointed by a Finance Party to determine a Dispute, the Agent may (and, if so instructed directed by the Majority Lenders, shall) by notice in writing to the Borrower require that all Disputes or a specific Dispute be heard by a court of law. If the Agent gives such notice, the Dispute to which such notice refers shall be determined in accordance with Clause 10 36.5 (Jurisdiction).

Agent’s option. Before an arbitrator has been appointed by a Finance Party to determine a Dispute, the Agent (if acting on its own behalf) may (andand shall, when acting on behalf of the Lenders, if so instructed by the Majority Lenders, shall) by notice in writing to the Borrower all other Parties require that all Disputes or a specific Dispute be heard by a court of law. If the Agent gives such notice, the Dispute to which such that notice refers shall be determined in accordance with Clause 10 39.1 (Jurisdiction).

Agent’s option. Before an arbitrator has been appointed by a Relevant Finance Party to determine a Dispute, the Agent may (and, if so instructed by the Relevant Majority Lenders, shall) by notice in writing to the Borrower require that all Disputes or a specific Dispute be heard by a court of law. If the Agent gives such notice, the Dispute to which such notice refers shall be determined in accordance with Clause 10 8 (Jurisdiction).
