Common use of Agent's Rights as a Bank Clause in Contracts

Agent's Rights as a Bank. With respect to the commitments of the Agent as a Bank hereunder, and any loans of the Agent to the Borrower under this Agreement, the other Loan Documents and any other agreements, instruments and documents delivered pursuant hereto, the Agent shall have the same rights and powers, duties and obligations under this Agreement, the other Loan Documents or other agreement, instrument or document as any Bank and may exercise such rights and powers and shall perform such duties and fulfill such obligations as though it were not the Agent. The Agent may accept deposits from, lend money to, and generally engage, and continue to engage, in any kind of business with the Borrower as if it were not the Agent.
