Notwithstanding any other provision of this Lease or the other Operative Agreements, Lessee shall not be permitted to terminate this Lease with respect to a Property pursuant to Section 16 or exercise its Purchase Option with respect to a Property pursuant to Section 20.1 if the Aggregate Tranche A Percentage, after giving effect to the termination of this Lease with respect to such Property, would be less than 87.6%.
