Common use of Agreed forms Clause in Contracts

Agreed forms. In this Agreement, any document expressed to be “in the agreed form” means a document in a form agreed by (and for the purposes of identification signed by or on behalf of) the Borrower and the Facility Agent or (in the case of any of the other Security Documents) a document in the form actually executed by both the relevant Security Party or relevant Security Parties and the Security Agent.

Agreed forms. In this Agreement, any document expressed to be “in the agreed form” means means (a) where a document Security Document has already been executed, such Security Document in its executed form; and (b) prior to the execution of a Security Document, the form of such Security Document separately agreed by (in writing between the Agent and for the purposes of identification signed by or on behalf of) the Borrower and the Facility Agent or (in the case of any of the other Security Documents) a document in as the form actually executed by both the relevant in which that Security Party or relevant Security Parties and the Security AgentDocument is to be executed.
