Agreement Contingencies. The Development agreement is contingent upon Developer receiving an approved ▇▇▇▇▇▇▇▇▇▇ plan, Act 381 plan and state TIF.

a) The availability of the Equipment and related parts and accessories.
b) The net meter installation as set forth in Section 8 (for Solar Energy Production System Work).
c) The successful attainment of the necessary building, mechanical, and/or electrical permits from all applicable jurisdictions (city, county, or state). If the Company is unable to commence Work due to permitting issues, this Agreement shall be null and void and the Company will refund to Client the Payments received less the costs of work already performed and a fee not to exceed $500.00 (the 'Administrative Fee'). The Administrative Fee shall cover administrative costs associated with the Company’s efforts to obtain proper permitting.
d) For a Scope of Work that includes a Solar Energy Production System, this Agreement is contingent upon acceptance of the Utility Interconnection Application by the local utility. If the Utility Interconnection Application is rejected by the local utility, this Agreement shall be null and void and the Company will return to Client Payments received less a fee for actual time incurred at the Company’s usual billing rate for such application (the 'Utility Application Fee'). The Utility Application Fee shall cover administrative costs associated with the Company’s efforts to obtain all necessary approvals for the Utility Interconnectiong Application, plus any non-refundable rebate deposits or other application fees made by the Company on behalf of Client.
Agreement Contingencies. The ability and obligation of the Parties to perform under this Agreement is contingent upon: (a) the execution of the Western Pipeline Agreement which shall include provisions ensuring the financing thereof, referenced in paragraph 3.2.1; and (b) issuance of a permit satisfactory to the Parties by the U.S. Army Corps of Engineers (Corps) allowing water delivered under this Agreement to be stored in ▇▇▇▇▇▇-▇▇▇▇ Reservoir. The "Effective Date" of this Agreement shall be December 31, 2013. If these contingencies have not been satisfied as of December 31, 2014, the Parties agree to terminate this Agreement or extend the dates set forth in this Agreement. 23
Agreement Contingencies. The validity of this Agreement is contingent upon the Operator completing construction of the Ballroom and obtaining from the City a certificate of occupancy . This Agreement is further contingent upon the Operator maintaining any government approvals required to operate the Resort at the Property. The City’s approval of this Agreement does not have any binding effect on any future land use applications or other approvals that the City may consider relating to the development of the Property or operation of a Resort on the Property.
