Allocation process. If one Natural Gas Storage Facility is used by several Storages Customers, SSO shall determine the respective quantities for each Storage Customer via Allocation processes. This is necessary due to the fact that the Natural Gas quantities are delivered and taken-over together and the measuring procedure is carried out in an undivided manner accordingly. The basis of the Allocation is the Nominations which were matched with the adjacent Transmission System Operator as well as the Allocation rules which were agreed with him. Basically, it shall be assumed that the declaration process applies, i.e. the allocated gas quantity per hour matches the amount of the last confirmed Nomination. Regarding the procedure between SSO and adjacent Transmission System Operator this may be shown inter alia through the non commercial use of an operational balancing agreement. Contrary to this, the process of proportional Allocation or the process of declaration with taking- over of difference quantities through a balancing shipper may be applied in individual cases where required. SSO will inform about this by communicating its reasons.
Allocation process. An advert will be prepared for submission to the Exeter City Council Home choice allocations scheme. The advert will describe the property types and sizes available for letting. The standard information with regard to property attributes and rent levels will be included. The properties will be openly advertised to all bands. Upon closure of the bidding process applicants will appear on the shortlist in band and date order. The final selection of applicants to be verified for the vacancies will depend upon their application band (housing need), the length of time they have been in this band, and the overall aims and objectives of this Local Lettings Plan. This may require some applicants to be considered before others irrespective of their relevant banding and dates.

The decision of such arbitrator shall be final and binding.

Allocation process. (i) The Housing Provider will inform the District Council and ASC when a vacancy, or impending vacancy occurs or is likely to occur, within one of the Scheme units. Such a notification shall be made via email to the District Council’s and ASC’s respective nominated individual(s) within 2 working days of the vacancy or notice of the vacancy becoming available;
(ii) The District Council and ASC will notify the Housing Provider of any suitable nominations into the prospective vacancy;
(iii) Any such nominations will be considered by a Selection Panel, consisting of the Scheme Manager and representatives designated by ASC, the District Council and the Care Provider. Where a prospective tenant has been identified by ASC, the selection panel must be convened within five working days or as soon as operationally practicable thereafter. When appropriate, other professionals, such as NHS staff, will be consulted. As vacancies occur, the Scheme Manager will promptly notify the other members of the selection Panel, and will promptly arrange a face-to-face or telephone meeting to discuss the nominations. While the final decision rests with the Housing Provider, it is hoped that usually selections will be made by consensus.
(iv) The discussions of the Selection Panel, the basis for selection of a tenant and the outcome of the process will be recorded in a minute prepared by the Scheme Manager and distributed to all Panel members.
(v) In the event that the Housing Provider rejects a nomination, the reason for the rejection must be documented and must be reasonable. For the avoidance of doubt, the reason for rejection provided must be in line with equality and diversity legislation and policies of CCC and the District Council;
(vi) In the event that a nomination is refused, the Selection Panel will consider at that same meeting any further nominations made by ASC and/or the District Council into that prospective vacancy;
(vii) The District Council and ASC’s option to nominate into a vacancy within one of the flats will be time limited to 3 weeks. Therefore, provided that the District Council and ASC receive the requisite notice of vacancy from the Housing Provider as set out in this paragraph 7, if ASC or the District Council do not offer a nomination into one of the Scheme units during the initial three week period of the vacancy becoming available, the Housing Provider is free to allocate that unit as they see fit;
(viii) When a potential tenant has been identified, he/...

The date of the signing of this written acknowledgment is referred to in this Restated Agreement as the “Allocation Date.” If the Embodiments and other Technical Information and materials set forth in Exhibit B relating to a particular Nuvelo Gene are materially damaged or destroyed before Acceptance, then Nuvelo is entitled to exchange such damaged or destroyed Nuvelo Gene for a Deltagen Gene at an equivalent stage of development.
