Allocation to Class Members. Class Members’ estimated proportionate share of the Net Settlement Fund shall be determined by the Settlement Administrator pursuant to the following formula: 1. Collective Members will receive one (1) point for each Eligible Workweek worked during the FLSA Collective Period; 2. California Class Members will receive one and one-sixth (1.1667) points for each Eligible Workweek worked in California during the California Class Period; 3. To calculate each Class Member’s initial proportionate share: a) Add all points for all Class Members together to obtain the “Denominator”; b) Divide the number of points for each Class Member by the Denominator to obtain each Class Member’s “Portion of the Net Settlement Fund”; c) Multiply each Class Member’s Portion of the Net Settlement Fund by the Net Fund to determine each Class Member’s initial proportionate share. d) For each Class Member, their Net Amount will be the amount of their Settlement Check, except that PAGA Members will be entitled to an additional Net PAGA Amount, as set forth below. 4. For avoidance of doubt: No Class Member shall be entitled to a double recovery for any one workweek based on their status as both California Class Member and Putative Collective Member. However, California Class Members who fall within the PAGA Members group shall be entitled to recover from the Net Fund and the PAGA Payment for the same workweek based on their inclusion in both the California Class and the PAGA Members group.
Allocation to Class Members. A. Class “A” Members. For purposes of calculating the share of the Gross Settlement Fund allocable to the 58 Class Members on Exhibit “A” that did not submit a claim to the Settlement Claims Administrator in connection with the settlement of the Membrives Action (the “Class A Gross Claimant Fund”), the amount shall be One Hundred Thirty One Thousand Dollars ($131,022.00) Each Authorized Claimant will be entitled to a flat payment from the Class “A” Gross Claimant Fund of $2,259.00 as his/her Individual Gross Amount, before taxes. B. Class “B” Members.
Allocation to Class Members. (A) A Class Member who does not opt out pursuant to Section 2.5 will be deemed eligible for a payment hereunder and will be a “Participating Class Member.”
