Common use of ALPS Appointment and Duties Clause in Contracts

ALPS Appointment and Duties. (a) The Fund hereby appoints ALPS to provide the distribution services set forth in this Agreement on Appendix B, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

(a) The Fund Funds hereby appoints appoint ALPS to provide the distribution administrative services set forth in this Agreement on Appendix BA hereto, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. The Funds acknowledge that ALPS shall for all purposes be deemed to be an independent contractor does not render legal, tax or investment advice and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fundthat ALPS is not a registered broker-dealer.

(a) The Fund and ALPINE hereby appoints appoint ALPS to provide the distribution administrative, bookkeeping and pricing services as are set forth in this Agreement on Appendix BA, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

(a) The Fund Funds hereby appoints appoint ALPS to provide the distribution services set forth in this Agreement on Appendix BA, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund Funds in any way or otherwise be deemed an agent of the FundFunds.

(a) The Fund and Advisor hereby appoints appoint ALPS to provide the distribution administrative, bookkeeping and pricing services as are set forth in this Agreement on Appendix BA, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

(a) The Fund hereby appoints ALPS to provide the distribution marketing, administrative, bookkeeping and pricing services as are set forth in this Agreement on Appendix BA, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS Appointment and Duties. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS Appointment and Duties. ALPS hereby accepts such appointment and appointment, agrees to furnish such specified services. services and to be named in the Fund’s registration statement and prospectus as its “Distributor.” ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS Appointment and Duties. (a) The Fund Company hereby appoints ALPS to provide the distribution services set forth in this Agreement on Appendix B, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund Company in any way or otherwise be deemed an agent of the FundFunds.

(a) The Trust on behalf of the Fund hereby appoints ALPS to provide the distribution administrative, bookkeeping and pricing services for the Fund set forth in this Agreement on Appendix BB hereto, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund Trust in any way or otherwise be deemed an agent of the FundTrust.

(a) The Fund hereby appoints ALPS to provide the distribution services set forth in this Agreement on Appendix B, Appendix C and Appendix D hereto, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS Appointment and Duties. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Fund in any way or otherwise be deemed an agent of the Fund.
