Common use of Alternative Distribution Agreements Clause in Contracts

Alternative Distribution Agreements. The Company has also entered into identical distribution agreements (“Alternative Distribution Agreements”), dated of even date herewith, with Xxxxxxx Lynch, Pierce, Xxxxxx & Xxxxx Incorporated, Deutsche Bank Securities Inc., X.X. Xxxxxx Securities Inc. and UBS Securities LLC (each, an “Alternative Manager,” and together with Xxxxx Fargo Securities, LLC, the “Managers”). The aggregate offering price of Shares that may be sold pursuant to this Agreement and any Common Stock to be sold under any Alternative Distribution Agreement shall not exceed the Maximum Program Amount. This Agreement and the Alternative Distribution Agreements are sometimes hereinafter referred to as the “Distribution Agreements.”
